Greece: State liability in Greece for the revocation of an illegal administrative act and the principle of protection of legitimate expectations of the addressee - Council of State Judgment 980/2002
Article Abstract:
The Council of State judgment 980/2002, in relation to an addressee being appointed and then dismissed by revocation of an illegal administrative act, holds the State liable for damages in every case of revocation of an unlawful administrative decision favorable to the addressee, regardless of the outcome of any balancing between the legality of the Administration and the protection of the legitimate expectations of the addressee. This introduces a just and bold 'corrective intervention' of the Administrative Courts in favor of the private individual.
