Spontaneous strike notice: who is responsible?

Section 8(d) of the National Labor Relations Act of 1935 (NLRA) was amended by Congress in 1947 to disallow spontaneous strikes, making it unlawful to have a strike or lockout without sufficient notice to both the affected parties and designated mediation agencies. The National Labor Relations Board (NLRB) reversed precedent in 1985 by ruling that the obligation for notification as required by section 8(d)(3) was on the party initiating the negotiations rather than the party causing the strike or lockout. If a spontaneous strike occurs, it is not certain how the NLRB will rule since there have been no decisions since 1985 addressing the issue of a strike without proper notice. Employers must ensure that they send timely notification to mediation agencies after initiating negotiations to avoid being struck by a union without notice.

It is very common for male graduates in the UK to earn considerably more than their female counterparts, according to the Institute of Employment Studies. This is partly because women tend to be more honest than men about their abilities, and therefore only apply for jobs which they feel they could handle properly, and partly because men are more willing than women to take risks. Women usually base their job searches on training, skills and work experience, whereas men are prepared to stretch the truth about their abilities.
