Does an A E have a property interest in its design-build proposal?

Article Abstract:

The Court of Appeals of Idaho, hearing the case of property interest rights for A E over a design-built jail, ruled that the submission of building proposals to the county did not give property interest rights to the A\Es. The competitive building statutes for design-build contracts allow property interest rights only to the lowest responsible bidder and not to all potential bidders. Moreover, the county's request for proposals was only intended for planning and receiving information and did not lead to an obligation to accept any of the proposals.

Architect/engineers may have contractual obligations to third parties

Article Abstract:

The design professionals, the owner and the contractor must work together to manage their contractual duties otherwise legal complications may arise involving all the three parties. Contract language is important, and contracting parties must enumerate the points of the contract clearly to avoid legal complications.
