The role of the academic nurse and physician in the criminal prosecution of nursing home mistreatment

Article Abstract:

Academic nurses and physicians play an important role as witnesses in the cases of criminal prosecution of nursing home mistreatment and inadequate quality of patient care. The collaboration of the health care professionals with the Pennsylvania Attorney General's office enabled testification of two patients' death cases as resulting from negligence of the staff. The academic nurses and professionals helped the prosecution in understanding the medical complexities of the cases and responsibilities of the staff. The roles and perspectives of the academicians and the legal personnel are discussed.

Nursing home resident abuse by staff: exploring the dynamics

Article Abstract:

A grounded theory study of abuse of nursing home (NH) residents by NH staff identifies several social structural factors that influence the staff's reaction to aggressive and abusive NH residents. The findings indicate that NH staff who do not develop immunity to resident abuse and those who do develop immunity but cannot sustain it are the most likely to be abusive or neglectful of NH residents. The structural aspects of the NH found to contribute to staff abuse include inadequate numbers of staff, low wages, unsupportive NH policies and programs.
