Misfit power, the First Amendment and the public forum: is there room in America for the Grateful Dead?
Article Abstract:
The problems faced by the Grateful Dead, a rock group whose devoted fans have prompted some communities to ban their concerts, illustrate some deficiencies in current First Amendment public forum doctrine. The 'secondary effects' test developed in City of Renton v Playtime Theatres, Inc has recently been extended to public forum cases, giving too much deference to local lawmakers. The Renton test allows seemingly content-based regulations of free speech to be justified by a desire to avoid harmful 'secondary effects.' Grateful Dead bans have not been tested in court, but current law clearly favors the local communities.
