Very limited number of defences for operators
Article Abstract:
The case in which a leading tour operator was forced to pay compensation to two women travellers who suffered sexual harassment by waiters at a Tunisian hotel could have wide-reaching implications for tour operators. It relates to Article 5, under which organisers are liable to the consumer for the proper performance of the obligations of the holiday contract. This article, which is implemented in Regulation 15, gives operators a high level of legal liability.
