Corporate ethics compliance programs: the new state of the art

Article Abstract:

The incidence of white collar crimes and corporate scandals in the 1990s is expected to be lower than in the 1980s. This is because a growing number of firms are adopting internal ethics compliance programs in response to a 1991 legislation known as the corporate sentencing guidelines. This law imposes stiff penalties on businesses found guilty of violating federal laws, but also offers a sizeable reduction in fines if the convicted company is found to have had effective compliance programs at the time of its offense. The law uses several criteria in determining the effectiveness of such programs. They must be suited to a firm's specific needs and risks, managed by 'high-level personnel' and communicated to all organizational members. Also, measures must be taken to ensure that employees who tend to behave illegally are not given too much authority, that concrete steps are taken to assure compliance and that violations of the company's code of ethics are punished.
