Apple receives reprieve, for now, on copyright suit

Article Abstract:

Federal District Judge Vaughn Walker agrees to reconsider a decision to invalidate Apple's copyright suit against Microsoft Corp and HP. In the suit, Apple accused Microsoft and HP of illegally emulating the style of Apple Macintosh computers in developing rival software programs. The charge was annulled by Walker in Apr 1992. In his decision made in Apr 1992, Walker stated that Apple was not entitled to copyright protection because the similarities between the programs were industry standards and not of Apple's creation. While some insiders believe that Walker will not change his decision, Apple's lawyers view the new hearing as a antecedent to a wider victory, involving perhaps a trial on the overall configuration of the Apple Macintosh system.

Apple can widen copyright lawsuit against Microsoft

Article Abstract:

Apple Computer Inc is allowed by US District Judge Vaughn Walker to expand its copyright lawsuit against Microsoft Corp to include the latter's Windows 3.0 graphical user interface. The decision also permits Apple to include HP's current New Wave version in the case. Apple is barred, however, from including breach of contract charges against Microsoft. Apple's suit against Microsoft and HP contends that both companies illegally copied the visual displays of the Apple Macintosh for their user interfaces. The inclusion of Windows 3.0 is significant because the version has sold more than a million copies, while the earlier versions did not sell as well. If Apple wins, other software companies developing Windows 3.0 applications could be affected.
