Article Abstract:

The cost of litigation in insolvency cases are paid by Litigation funds, a relatively new phenomenon, which also indemnify the plaintiffs against the adverse court orders made against them to pay the other side's cost. Insolvency Litigation Fund, a wholly owned subsidiary of publicly listed company IMF (Australia), and Litigation Lending Services, are the two Litigation funds operating in Australia, which settle most cases out of court and take up to forty percent of the proceeds from claims.

The lack of interest of the institutional shareholders in Australia to vote on board resolutions is discussed. Their demand for a compulsory voting by the superannuation fund trustees on board resolutions is detailed.
