Microsoft wins round in court fight

Microsoft Corp. won a stay verdict at a federal appeals court in order to postpone Judge Thomas Penfield Jackson's decision to split the company in two. The software company also requested that the case should not bypass the appeals courts and jump to the Supreme Court as it is not appropriate in a complicated lawsuit, such as this one.

Judge Thomas Penfield Jackson criticized the U.S. Court of Appeals for a1998 reversal of a decision he'd handed down against Microsoft. The same Washington D.C. court is hearing the latest Microsoft appeal of Judge Jackson's 2000 ruling, ordering the breakup of the software company. Judge Jackson has made other remarks against Microsoft and its employees since his ruling. Microsoft attorneys have introduced these quotes into their appeal. The latest remarks appeared in a New Yorker magazine excerpt from the book 'World War 3.0: Microsoft and Its Enemies,' by Ken Auletta.
