Article Abstract:

AIDS lawsuits can incur greater expenses than the medical costs for employees inflicted with AIDS. The Americans With Disabilities Act clearly states that discrimination against employees and job applicants with AIDS is illegal. As such, employers must be careful lest they may find themselves in court. As a rule, they should refrain from requiring a medical exam unless they have decided to take in the applicant or they have evidence that workers with AIDS cannot do their job well. A job offer can only be revoked once the employer can prove that the HIV-infected employee has been inefficient because of his illness. Strict confidentiality must also be maintained at all times.

An accrual-basis taxpayer may deduct payments for a variety of expenses even if actual payment is not made in that tax year. Reasons a tax deduction may be disallowed are listed. If a deduction is disallowed, it will be lost for any year in which the expense is paid.
