AUSTRIA: DISPUTE OVER MOBILE PHONE FREQUENCIES

Article Abstract:

The European Court of Justice will decide if the Austrian mobile phone operator Mobilkom may already use the 1,800-MHz frequency. The competitor Connect Austria (One) is not satisfied with the decision of the Austrian regulators to grant a free 1,800-MHz licence to Mobilkom. Connect Austria was to have the exclusive right of the frequency until August 2000 but had to face competition earlier because Mobilkom could not serve all its clients with the 900-MHz frequency. The regulators may have violated the law by strengthening the leading position of the state-owned company Mobilkom. Connect Austria cannot expect a final decision until August 2000, after which the competitor can easily get a new licence. The company can at best expect compensation from the state.
