AUSTRIA: COURT STOPS SHOPPING DEVELOPMENT RULES

Article Abstract:

Austria's constitutional court has overruled a decree that restricts the building of shopping premises with areas of more than 800 sq.m. According to the decree, new shopping developments outside city centres are not allowed if they drain more than 5% of the turnover of the retail sector concerned. The calculation was based on a radius that can be reached within 10 minutes by car. Rather than all products and services, the court held that the decree should cover only products that are consumed daily or almost daily. It is estimated that the court ruling will result in less strict rules for new developments in fields such as furniture, DIY, tableware and jewellery trade. The decree that had been challenged by Media Markt will become ineffective from 1 July 2000. By then the economics ministry is to draw up a new decree.
