Environmental protection and the GATT: a business view

Article Abstract:

The GATT panel ruling against the US ban on tuna imports from Mexico a violation of its rules indicates the growing conflict between the protection of domestic resources and international trade. This issue may be resolved by strengthening the GATT's ability to encourage domestic environmental protection without prejudice to economic growth. The present panel dispute settlement process may be revised to one that does not affect the right of any of the disputing parties to reject the proposal provided that they pay the necessary compensation.

New corporate roles in global environmental treaty-making

Article Abstract:

The present convention-protocol approach to environmental treaty-making followed by the UN does not require signatories to take action on specific guidelines agreed upon and imposes the same requirement on all signatories regardless of their special circumstances. The recommendations of the Salzburg Initiative allow for a three-stage synchronized system that provides countries and nongovernment institutions adequate time to muster their technical resources and to plan ahead.
