Engineering testimony may be judged more strictly

Article Abstract:

The US Supreme Court decision in Kumho Tire Co Ltd et al vs Patrick Carmichael et al provided that engineers can be held to the same standards as other scientific professionals when testifying as experts in court cases. The ruling is in line with the positions taken by the American Consulting Engineers Council and the National Academy of Engineering. Observers think that the ruling is positive since it permits but does not require trial judges to evaluate the reliability of engineering testimony.

Don't Waste Time Merchandising One Supplier

Article Abstract:

Three questions should be asked regarding the merchandising of an item to the user. They are, what is the objective, will this be used by the retailer, and will it be effective. A few devices that have proved to be successful are consumer rebate, free goods offer, sample merchandise, display material in store demos, and packaging. These tools will work if they are not overused and if the competition does not use them.
