Perfect proof

Article Abstract:

The burden of proving a fact in litigation usually falls on the person who says it is true and they have to adduce evidence, which may include expert evidence to persuade the court that on the balance of probabilities, their version of events is right. The Court of Appeal has rejected the findings of a judge who had decided between conflicting expert evidence on the basis that the claimants had not discharged their burden of proof.

Exactly how far does an English adjudicator's jurisdiction reach?

Article Abstract:

The case of Comsite v Andritz in April 2003 in Great Britain where the court was asked in advance for a declaration about adjudicator's jurisdiction is discussed. Comsite received assurance that its work fell within the adjucator's jurisdiction and under the contract, it could take any dispute with Andritz to adjudication.
