The UK Court of Appeal has criticized the Construction (Design and Management) Regulations for lack of coherence. It is clear that an urgent review of these regulations is now required.

Why a trip down memory lane could pay dividends in court

Many principles of construction law are based on old cases, where the employers were the king and the other participants in the building process were far less important. In the modern time, many general principles are heavily modified by contract terms, making standard forms that are commonly regarded as anti-employer.

The marriage of registration and legal duties - Hong Kong-style

Article Abstract:

A building authority is responsible for building in Hong Kong. This authority holds a register of authorized people, including surveyors, architects and engineers. An employer who wishes to build must appoint an authorized person. These people have a wide range of responsibilities, including preparing all plans and all structural details and certifying that the works comply with the approved plans and that the building is structurally safe. One drawback of this approach is that the authorized person appears not to benefit from any immunity. It is interesting to consider how registering individuals would function in the UK.
