RWE fights cartel ruling

RWE faces a ruling from Germany's competition authorities that a 20-year exclusive contract to supply electricity to Nordhorn in northwest Germany involves too much monpoly power. The authorities are seeking to liberalize electricity supply in Germany. Generators avoid competition through long-term contracts with municipalities. RWE aims to challenge the ruling which it argues is not legally correct. Legal disputes of this nature could occur throughout the late 1990s.

Southern Electric has been involved in three attempts to carry out a merger which have not succeeded in the year to Aug 1996, but the company has performed well in other areas. The company's core business of electricity distribution is expanding and the company has resources to carry out an acquisition, pay a further special dividend or purchase its own shares. The company could be affected by a windfall tax but is well placed to weather this.
