What is an employer's obligation? A legal guide for hiring contingency workers

Article Abstract:

Contingency workers are classified into interns, temporary employees, independent contractors, contract employees or cooperative education students. According to the employment discrimination laws implemented by the Equal Employment Opportunity Commission, the employer's obligations depend on the outcome of the review to be conducted by the agency on the worker's relationship with the staffing firm. For instance, independent contractors are not protected by the law. In contrast, contract workers and interns are considered hired employees and are protected by the law.

A quick review of IRCA's basic antidiscrimination provisions

Article Abstract:

The protection of employment candidates against discrimination by national origin is given by the Immigration Reform and Control Act (IRCA) of 1986. The recruitment of any alien employee who is not authorized to work in the United States is also prohibited by the IRCA. IRCA has taken measures to reduce discrimination against eligible workers. Confusion has been created among employers in handling the large number of documents required by the law.
