Holiday dilemmas

Article Abstract:

A self-employed construction worker sued his employer for wages he claimed he earned as holiday pay. A court ruling distinguished between self-employment and being an employee, finding that since the worker was self-employed he was not entitled to holiday wages.

A matter of life and death: ignorance is no defence when you're facing health and safety charges. Nor should it be, when the consequences can prove fatal to innocent bystanders

Article Abstract:

An immediate inquiry into the collapse of the walkway at the Port of Ramsgate was launched by the Health and Safety Executive and the Port of Ramsgate. The HSE brought a prosecution against the two Swedish companies under the Health & Safety at Work Act 1974, saying that the builders had a duty to undertake the work in a manner that would not affect persons in their employment. The Swedish contractors did not appear in court, therefore a plea of not guilty is entered. The Port of Ramsgate was tried and found guilty, and Lloyd' Register of Shipping pleaded guilty. Port of Ramsgate protested that it had no engineering knowledge or experience, but a plea of ignorance is never accepted by the HSE.
