Contractors' escape blocked up

Article Abstract:

The UK building contract case, 'Balfour Beatty Building versus Chestermount Properties' abolished the contractors right to deduct liquidated damages for the time before the variation. The contractor, Balfour Beatty claimed that it was entitled to complete 54 weeks from the extension date rather than from the original date, 9 months previously. The court decided that the architect's extension should be adherred to giving Beatty 18 weeks to complete. The architect was correct in using the 'net' method for calculating the time extension.

Insurance company Housing Association Property Management has published a new booklet aimed at helping housing associations procure the best design-and build contracts. The guidelines, entitled 'Guide to Design and Build', are targeted at housing association development officers and contain an analysis of contract documentation from a typical sample of housing association schemes. It also aims to provide housing associations with all aspects of establishing a design-and-build contract.

Quantum meruit claims: a formal contract does not always exist for building work, and so there is no framework for claims

Article Abstract:

Formal contracts for building work do not always exist and there is no standard opinion on how quantum merit claims should be valued. A 'cost plus' basis would provide a fixed amount with referral to labour, plant and materials costs, which should lead to greater certainty.
