Courts strike back

Article Abstract:

Steps were taken under the Arbitration Act 1996 to make arbitration an attractive dispute resolution option for UK construction companies. However, it has recently become more common for arbitration clauses in standard building or engineering contracts to be removed, and parties to construction contracts are in some cases making an agreement to litigate. In other cases, they are postponing a decision on whether to use arbitration or litigation until a dispute actually arises. One reason for this is that arbitration can be very expensive, whereas the time of judges and courts is free.

Creeping euro

Article Abstract:

The introduction of the single European currency, the euro, on Jan 1, 1999, will have significant implications for any UK construction company tendering for work in Europe, dealing with a Europe-based client or exporting to Europe. The Construction Confederation warns that it is vital to be prepared for the euro, rather than simply waiting to see what happens. Similarly, the Confederation of British Industry is calling on companies to address the euro as soon as possible at board level. The euro will have a particularly significant impact on information technology systems.
