Cracking the code

Article Abstract:

The lengthy and difficult nature of arbitration law in Scotland will be vastly improved by the introduction of new regulation providing a practical code for arbitrators to follow. Parties will need to agree to bid by the new arbitration code as the regulations are not legally bidding. The new framework is expected to make arbitration cases, faster, less costly and ultimately fairer for all those concerned.

The final straw

Verbal agreements concerning final account payment details which are later disputed can often be settled under Section 108(1) of the Construction Act. The occurrence and settlement of grey areas is discussed.
