Designing for safety

Article Abstract:

The approved code of practice which has been drawn up as part of CDM regulations for the UK construction industry contains elements which are particularly applicable to design and build schemes and which do not yet appear in standard form contracts. A design and build contract needs to cover issues including the establishment of an acceptable health and safety plan and methods for dealing with post-contract work, both on the health and safety plan and for the review of post-contract designs.

Impossible? That depends

Article Abstract:

There are a number of circumstances in which it may be physically impossible for a construction contractor to undertake the work required. In some cases, this could be because no materials are available to meet a particular specification, while in others it could be that achieving a certain specification is theoretically possible but extremely expensive. There have been a number of legal cases where judges have rejected the view that 'impossible' should be given its literal meaning.

Construction of contracts

Article Abstract:

Legal arguments between employer and their contractors can be very complicated, particularly when sub-contractors are involved. An Arbitration process must be used where a contractual obligation occurs, although it is often difficult to find an arbitrator who has special knowledge in technical matters together with adequate legal expertise. Sub-contractors contracts are legally binding to the employer and the contractor, since the work affects all parties.
