Does AIA's new delegation of design responsibility clause affect you?

Article Abstract:

Thousands of court decisions through most of the 20th century involving interpretations of the Standard Form Documents of the AIA attest to the enduring significance of these forms. One of the most controversial and significant changes in The General Conditions for the Contract for Construction (A201-1997) form is the delegation of design responsibility clause (3.12.10). The clause raises serious many potential issues regarding consequences at least to the owner and the building team, and risks to contractors, subcontractors and materials suppliers. Yet it would be incorrect to conclude that this amendment should be opposed by suppliers, contractors and subcontractors.

A vindication for asbestos

Article Abstract:

Asbestos fibers can be safely used in a mixture with asphalt, ruled the US Court of Appeals. This ruling has prompted the Occupational Safety and Health Administration to strike out from any asbestos construction standards any regulations covering asbestos-containing asphalt roof cements, coatings and mastics. The roofing industry, however, continues to take a hands-off approach to asbestos for fear of a public backlash.
