Fair play in everything

Article Abstract:

Court cases in the UK, Australia, Canada and New Zealand have all upheld the obligation for the tendering process to be conducted fairly and without prejudice. The Australian courts pointed out the tendering process must be fair and for all tenderers to have the same opportunities. AirServices Australia was found to have been in breach of contract for introducing new criteria when they evaluated the bids. Other courts found instances of tenders not being opened in accordance to the defined procedures or a mistake in one bid being changed after bidding had closed.

It is clear that the current situation regarding cash retentions in the UK construction industry cannot be allowed to continue. Cash retentions create unnecessary costs, and in some cases can be the cause of disputes. However, there are mixed views about whether a shift towards a universal system of retention bonds would be a positive step. Some observers believe that retention bonds would add to construction costs and would not necessarily encourage everyone in the supply chain to undertake work properly and to deal with any defects.

Article Abstract:

An expert from the major building contractor industry maintains that main contractors have an important project co-ordination role to play in the construction industry, whilst a specialist engineering representative maintains that main contractors are predators surviving on their ability to maintain a cash flow by manipulating the payments system. Direct contracts with specialists account for only 2% of all contracts but this could be representative of clients' inertia rather than a preference for the main contractor system.
