Article Abstract:

Some observers believe that most construction contracts used in the UK seem to encourage waste and inefficiency. They are mainly concerned with moving risk among the participants in the project concerned, and thus do not promote coordination. The construction industry must now make changes to its contracts to ensure that projects can be completed to the client's satisfaction. Others feel that lawyers should focus on brevity, simplicity and clarity when drafting contracts, thus allowing others to deal with productivity, site organization and logistics management.

Clashpoints for consultants

Article Abstract:

There are very mixed views about the bespoke consultancy agreements which frequently feature in large commercial construction projects in the UK. However, there are a number of clauses which it would seem unfair to include in such agreements. For example, it would not be justified to ask consultants to indemnify the client against losses incurred as a result of the consultant's break of contract or negligence. Similarly, consultants should not be asked to give guarantees and fitness for purpose warranties.
