Fall guys use JCT81 design-and-build

Article Abstract:

JCT81 has proved very difficult for contractors to work with, especially on design-and-build contracts. It makes little provision for alterations to the original valuation, and no independent certifier is used, so no payment certificates are issued. The contractor is deprived of almost all design responsibility, and the architect is likely to come under criticism from both the employer and the contractor. There are also frequent clashes between Employer's Requirements and Contractor's Proposals.

Critical acclaim for NJCC release

Article Abstract:

In Jun 1992, the National Joint Consultative Committee for Building published the 3rd revision of 'Tendering for Building works without Bills of Quantities.' Obtaining tenders without bills of quantities saves money and is currently being exploited. The document advises tenderers to list items and produce full information. A detailed analysis is required where work cannot be evaluated due to the absence of bills. Monies can be raised to pay for the cost of the analysis' preparation.

Plugging those inslovency gaps

Article Abstract:

Amendment 11:1992 of JCT80 (Joint Contracts Tribunal) has deleted and replaced Clauses 27, 28, 32 and 33. The amendment has resulted in reducing the text which included many redundant words. The new provisions aim to modernise the exisiting clauses and cover missing matters to make the standard contracts legally current, especially in the area of insolvency. Amendment 11 defines when a notice becomes effective.
