HSE law to penalise the client hardest

Article Abstract:

The UK Health and Safety Commission's proposed Construction (Design and Management) Regulations imposes strict health and safety duties on the client. The client has to: inform the local Health and Safety Executive office of a project; appoint a good planning supervisor and contractor; ensure adequate finance and inform the planning supervisor on the condition of the site. The regulation covers all constuction work including repair and maintenance, redecoration and external cleaning.

Article Abstract:

The New Construction (Design and Management) Regulations make the client responsible for appointing a planning supervisor and contractor. The client will have to analyse the amount of the contractor's tender, estimate the time needed for project completion and consider health and safety measures. Failure to analyse tender allowances will be in breach of duty as shown in a recent case, General Building and Maintenance versus Greenwich London Borough Council.
