Article Abstract:

Construction litigation success can be achieved through the use of specialist lawyers. Fenwick Elliott are the most innovative construction solicitors in the UK. Over 90% of their cases collapse or settle pre-trial, saving expense. Elliott have set up a computer programme called Retrospective Delay Analysis which deals with construction delay, loss and cost. About 28% of the firm's cases are settled with costs of under 1,000 pounds sterling and 30% with costs in between 1,000 pounds sterling to 5,000 pounds sterling. About 35% are settled within 12 months.

Sainsbury's blazing row

Article Abstract:

Architectural firm Broadway Malyan accepted that it had been negligent with regard to the design of a fire wall break at a J. Sainsbury store in Chichester, England, destroyed by fire in Dec 1993. However, it sought a contribution to the 7.12 million pounds sterling settlement from structural engineering Ernest Green Partnership. A judge has now ruled that Ernest Green Partnership does not have any liability, as this company was entitled to conclude that Broadway Malyan had considered what degree of fire protection was needed.

ICI faces mother of all court cases

Article Abstract:

ICI is sueing contractor, Bovis, engineer Oscar Faber and architect, GMW over the excessive cost of its Millbank, London, England headquarters refurbishment. The court case promises to be lengthy and complex but ICI has given itself a further problem by not preparing its claim before matters came to court. After an initial hearing, the company is having to compile its case retrospectively to avoid having it struck out.
