Article Abstract:

Court referrals of construction industry litigants to other forms of dispute resolution represent errors of perception. One of the alternative forms of dispute settlement, Alternative Dispute Resolution, is a valid and useful means of settling disputes in the construction industry. However, courts which force litigants to enter negotiations are failing to appreciate that the parties have decided to depend upon the legal system, rather than bargaining power, to settle their dispute. The existing situation indicates the need for a dispute advisory service.

Article Abstract:

The system currently operating in the UK construction industry requires both professionals and contractors to generate claims if they are to make a profit. It is now time to put pressure on leading clients to promote buying policies that encourage profitability. It is only in this way that leading UK contractors will really be able to compete against strong foreign rivals. Sir John Egan's report looks at this issue, as well as calling for the experience of completed projects to be carried forward into subsequent projects.
