Is your site a public place?

Article Abstract:

It is important for UK construction companies to ensure that their sites cannot inadvertently be regarded as a public place on which road traffic offences could be committed. This can be achieved through practical measures such as marking sites as 'closed to the public' and installing perimeter fencing. A number of cases have highlighted the fact that it can sometimes be difficult to establish whether a construction site is a public place or not.

Article Abstract:

Employers and sub-contractors may sometimes dispute final accounts and in some cases a part-payment is offered as a final settlement by mutual agreement. Such a situation, when both parties agree, uses a process known as accord and satisfaction, releasing them both from the contract. However, past legal cases reveal that the claimant may legally continue to pursue the balance after accepting partial payment.

Article Abstract:

Modifications to the United Kingdom Housing Grants, Construction and Regeneration Act 1996 will remove the contractor's legal right to full settlement upon project completion if the completion date is unacceptably late. Most building industry contracts will now include provision for installment payments. Full payment can only be demanded if the job has been completed to an acceptable quality standard.
