Judge cuts through identity crisis

Article Abstract:

The case brought by Tokola-High Force against NV Victor Buyck (NV VB) illustrates the care needed to ensure companies maintain their individual identity. In the case, Tokola-High Force claimed that Belgium based NV VB owed it money for a contract for the Canary Wharf project. However, NV VB had set up a UK based company, Victor Buyck which had signed contract documents with the management contractor, Bovis and sub-contractor, Tokola-High Force. The judge found the directors of NV VB and Victor Buyck had confused the identities of the two companies and that Victor Buyck was the contractor.

Schoolmaster case proffers legal fees

Article Abstract:

In Pepper versus Hart (1989) the House of Lords allowed a statement by a minister to be taken into account to clarify the meaning of a regulation. Previous to this references to parliamentary debates have been prohibited. The case involved the conflicting interpretation of a piece of tax legislation. Problems are caused in allowing ministerial intervention. If an amendment is passed it may be difficlt to know whether to examine the speech, amendment or legislator who accepted it.
