Article Abstract:

Construction industry contract experts will be required to prepare cases for adjudication, following contractural disputes. The individuals will need to be knowledgable about construction law and have experience in managing construction contracts. It is unlikely parties in dispute will have sufficient expertise to present their own cases. The 1996 UK Construction Act allows parties, who can not agree about a construction contract, to refer the problem for adjudication rather than going to court.

Article Abstract:

It seems logical that an employer's design team oversee a contractor's design-and-build project because the team is familiar with the project and has an understanding of the employer's needs. However, the novation principle has a basic flaw in that the contractor will have entered into a contract with the employer before the design team is involved. This situation can create dissent between the contractor and the design team. The advantages and disadvantages of novation are discussed.

Landfill: costing the earth

Article Abstract:

A new landfill tax in the UK will come into force on 1 Oct, 1996. From that time, landfill disposal contractors will have to pay a surcharge on any active and inactive waste. The extra cost will be reflected in future contracts, but some existing contracts do not allow for the new law and problems may arise when resolving who should pay. The provisions of some often-used standard forms are analysed with regard to the new landfill disposal tax.
