Sunk by your own float

Article Abstract:

A UK court ruling has decided sub-contractors can claim the benefits of a contractors time float if the project goes over time and the contractor deems it fit to try to sue the sub-contractor for breach of contract. The ruling was made after contractor McAlpine claimed 163,000 pounds sterling worth of damages from its basement contractor Ascon for being 10 weeks behind schedule. A five time float was found on McAlpines time sheets, which the court said should benefit the sub-contractor.

The UK law governing the enforcement of an adjudicator's award is discussed. The provisions of the Construction Act which do not permit unfair awards or mistakes to be reviewed and the remedies which could be applied by a judge are analysed.
