Troubled waters

Article Abstract:

The National Rivers Authority (NRA) has a duty to regulate water quality in the UK and has had a very high success rate for prosecutions against polluters. Many construction contractors are faced with site run-off problems and some well-known firms have been prosecuted by the NRA and received substantial fines. The NRA will likely prosecute under the Water Resources Act 1991, Section 85, which states that it is an offence to knowingly pollute controlled waters, such as rivers and streams.

Cleaning up - the Act. (impact of the new Environment Act on construction industry)

Article Abstract:

The new Environment Act comes into force in April 1996 with the aim of establishing an Environment Agency for England and Wales and a Scottish Environmental Protection Agency, to create a more integrated approach to environmental protection. The amendments to the 1990 Environmental Protection Act will be of particular interest to developers and contractors, as they attempt to set out a regime for cleaning land that could be a threat to environment or human health.
