Utah first state to prohibit sale of driver data

Article Abstract:

Utah became the first state to prohibit the sale of motor vehicle lists since the US Supreme Court validated the amended Driver's Privacy Protection Act (DPPA) in January. The DPPA allows states to require drivers to provide specific information before their data is released for any purpose with the exception of law enforcement. A number of states have opted to implement the law earlier than its June 1, 2000 effectivity date due to their legislative schedules.

Canada's privacy law goes into effect

Article Abstract:

Canada's Personal Information Protection and Electronic Document Act took effect in Jan 2001 and applies to US-based companies doing business in the country. The legislation establishes rules to govern the use, disclosure and collection of personal data by the private sector. Also known as C-6, the law requires foreign marketers with operations in Canada to secure explicit consent of customers before making commercial use of their personal information.

Supreme Court hears driver data case

Article Abstract:

A case pitting states' rights against motorists' privacy as embodied under the Driver's Privacy Protection Act of 1994 is being heard by the Supreme court. Reno vs Condon concerns South Carolina's constitutional challenge to the Act, which limits disclosure of personal information from state motor vehicle records. The law, which became effective in 1997, violates the 10th amendment, according to South Carolina Attorney General Charles Condon.
