Some legal experts have suggested partnering agreements between contractors in the UK construction industry should not be combined with legal contracts. If contractors decide to go to the courts to resolve a dispute they will need to outline how their partnering agreement affects their contracts. Although partnering agreements are not binding in law. The main aim of introducing the concept of partnering into the construction industry was to improve working relationships between contractors.

Construction industry insurance is a major requirement for the awarding of commissions, and contractors need to be able to show they are fully covered for any eventuality. UK construction industry regulator JCT is developing a set of provisions for consultants called Common Conditions which is hoped to set out standard formats for expressing a policy or idea. The new legislation is aimed at improving working relationships and developing partnerships.
