Article Abstract:

Designers have a legal responsibility to ensure clients are aware of any defects in the design of commissioned buildings. Professional advisers should monitor designers and report any problems which may occur. Designers should not be held legally responsible for work undertaken out of their scope but only that which impinges on work which falls under their jurisdiction. A ruling between retailers Tesco Stores and architectural firm Hitchcocks Partnership concluded Hitchcock had a responsibility to report design defects in connection with shell works carried out for the supermarket chain.

Face up to the year 2000

Article Abstract:

Contractors can take three precautionary steps to deal with the year 2000 computer problem. The most important information systems should be pinpointed and audited, then systems which will be affected by failure of the primary systems should be identified. Contractors should employ a lawyer to discover contractural agreements concerning liability for rectifying the problem and cost. Steps to have the problem put right should then be taken under the correct licence agreement. Non-compliant systems are still being sold to contractors, despite knowledge of the problem.

Article Abstract:

The Housing Grants, Construction and Regeneration Act, 1996, has been delayed and will take effect from January, 1998. The Scheme for Construction Contracts is the basis of the Act, and some problems pending have still to be addressed. The construction industry is increasingly aware that a system of partnering would be beneficial to all involved, reducing the possibility of minor disputes becoming major ones.
