When hard work does hurt

Article Abstract:

Employers legally have a duty of care to ensure their employees have a safe working environment, with this duty extending to the employees' psychiatric well-being. The judgment in the case of Walker v Northumberland County Council illustrates the legal protection provided for building industry employees seeking damages for nervous breakdowns caused by job stress. The court held the employer had no responsibility for Walker's first job stress-related nervous breakdown but should have taken reasonable measures to prevent the second nervous breakdown on his subsequent return to work.

More than you bargained for

Article Abstract:

Quantity surveyors and project managers involved in construction projects may face legal action on an increasing scale following a decision by the UK Court of Appeal. This case involved Eagle Star Insurance Co and Banque Bruxelles Lambert. An office block was overvalued and the owner could not repay a loan after the UK market for real estate had collapsed. All losses resulting from this transaction could be recovered, according to the decision, and this includes losses resulting from a drop in property prices.
