Why is a lawyer like a bull?

Article Abstract:

Architect Richard Saxon issued a direct challenge to lawyers at the 1999 annual luncheon of the Society of Construction Law. He stated that lawyers involved in construction-related work tend to focus on failure, rather than on success. He believes that the construction industry could considerably reduce its costs and improve client satisfaction if contracts were simplified and emphasis were placed on 'lean thinking,' eliminating unnecessary procedures and allowing greater flexibility in the construction process.

The pre-Christmas period offers a valuable opportunity for UK construction companies to seek to resolve disputes. People often feel forgiving towards others at Christmas, and they may therefore be willing to enter into negotiations and reach a compromise. However, it is important to record details of any compromise in writing. These details must be set down very clearly, and should be recorded straight away, as hesitating may mean that the appropriate moment for a compromise passes.

Article Abstract:

The once-popular nomination of sub-contractors in building work is set to stage a come-back. In the 1970s and 1980s the practice was a common occurrence, with the prime cost work on the bill of quantities done by a specialist subcontractor nominated by the architect. The alternative method of using a domestic subcontractor, although widely used subsequently, is inefficient. However, it seems that, once again, architects see the value of specialist sub-trades.
