Dubai: copyright judgment

Article Abstract:

The Dubai Court of Cassation decided in favor of the previous judgment given by the Dubai Courts of First Instance and Appeal regarding the copyright protection of foreign video cassettes. The Public Prosecutor claims that the cassettes were protected as they were printed for the first time in the U.A.E. Article 3 of the federal Copyright Law, which also covers the works of non-U.A.E. nationals printed for the first time within the country. Moreover, these works should be submitted to the Ministry of Information and Culture to be deemed protected under the Copyright Law.

Article Abstract:

United Arab Emirates' Dubai Court of Cassation has maintained the decision of a lower court involving the dismissal of a case against foreign defendants on the basis of lack of jurisdiction. The case resulted from a plaintiff's decision to detain the defendant's vessel sailing in Dubai. The court upheld the decision based on Article 21(7) of the Code of Civil Procedure, Article 82 of the Civil Code and Article 81 of the Civil Code, which states that a residence is a place where a person usually resides.
