Dubai denies enforcement of foreign judgments against local parties

Article Abstract:

Dubai's Court of Cassation has ruled that foreign judgments cannot be implemented in Dubai against people who could have been sued in the UAE initially. This ruling, which provides immunity to people and companies residing in or domiciled in Dubai, stems from the Law of Civil Procedure, which has been effective since Jun 9, 1992. The ruling is likely to provoke a reciprocal reaction from foreign countries as they will also refuse to enforce Dubai's judgments. It is hoped that the decision will lead to an amendment of the law.

Article Abstract:

A lower court decision in Dubai, United Arab Emirates involving a controversial termination of an insurance agency by a foreign insurance company was upheld by the Dubai Court of Appeal on April 30, 1997. The Dubai Court of Appeal argues that upholding the lower court's decision was based on a reason that a foreign insurance company has the right to terminate a contract with a local insurance agency if that agent acts on behalf of the foreign company's interest without its consent.

U.A.E. environmental law: Dubai and Jebel Ali

Article Abstract:

Dubai and the Jebel Ali Free Zone in the United Arab Emirates each have their own set of environmental laws. The Dubai Municipality has total control over environmental legislation in the emirate with the Local Order No. 61 of 1991 as the principal legislation. On the other hand, the Jebel Ali Free Zone is exempted from Dubai Municipality laws and has its own environmental regulations enforced by the Jebel Ali Free Zone Authority.
