Claims for appeal costs increasing

Article Abstract:

There has been an increase in claims for costs relating to appeals both by appellants and local authorities. A claim by McDonalds Restaurants relating to a Drive-Thru at Crawley was made in respect of an appeal allowed by the inspector. However a claim for costs was refused. Derby City Council claimed costs from the Halifax Building Society after an appeal relating to refusal of aplications for the consent for the erection of fascia signs on listed buildings. Full costs were awarded against the appellant.

Happier times for the holiday village. (applications for holiday villages increase)

Article Abstract:

There are increased applications by developers for holiday villages in the UK and such applications are inevitably called-in for determination by the secretary of state. A proposal for a timeshare holiday village on a site in Devon was considered in relation to effects on local tourism, economy and impact on the landscape and was refused as the scheme would have harmed the virtually unspoiled rural landscape.

Article Abstract:

Granting permission for advertising signs is a contentious issue. Advertising signs on a listed building in Barnard Castle's Market Place were not allowed, because they would have damaged the character of the building. An application for an amusement arcade in Barnsley was eventually approved as the arcade would not cause demonstrable damage.
