Damage control?

Article Abstract:

Dow Corning Corp will discontinue manufacturing its silicone-gel breast implants. The announcement to stop operations came after hearings conducted by the FDA sought the voluntary suspension of implant manufacture pending research results. The firm has been involved in a case involving its implants for which it was sued. Dow Corning countered with legal arguments, including federal preemption, statute of limitations and 'learned intermediary' doctrine. Regardless of the case's outcome, the firm's image has already been damaged.

The Supreme Court's action in Cipollone v Liggett Group, Inc may have effects beyond the tobacco industry, in particular there may be cause for alarm for those companies whose products are not well-known to be hazardous and where the intent of the government's restrictions are unclear. Many companies have become complacent with the proliferation of regulations by government agencies, but the recent rulings show that federal preemption may not provide needed protection.

Cleaning up the junk

Article Abstract:

Use of expert testimony in lawsuits is examined. Federal rule of evidence 702 allows testimony by expert witnesses if the trier of fact needs specialized knowledge to understand the case. The expert opinion should be based on a scientific technique that is generally accepted as reliable by the scientific community. Examples of admissible and inadmissible expert testimony are cited.
