Is hyperlinking to decryption software illegal?

Article Abstract:

A federal court in New York City has ruled, in a case now being appealed, that DeCSS software, which includes computer code that breaks the encryption scheme of digital video disks (DVD), is not speech of a sort that merits the constitutional protection given to 'pure expression.' The lawsuit was brought by the Motion Picture Assn of America against 2600, a magazine for hackers. Questions abound about what exactly is illegal under the Digital Millennium Copyright Act (DMCA).

Software giant, Microsoft Corp. has found itself a surprising ally, director of the World Wide Web, Tim Berners-Lee, who now heads the W3C. 12 years ago, he asked the head of U.S. patent and trademark office to re-examine a patent granted five years ago, to prevent substantial economic and technical damage to the operation of (the) World Wide Web.
