Mediation is not arbitration

Article Abstract:

Mediation and arbitration, though effective methods for addressing construction project disputes, should not be linked together because they are very different processes. Mediation is a nonbinding and voluntary process that is limited only to assisting disputing parties in looking for a mutually acceptable solution. Arbitration, however, is a binding process that involves introducing an arbitrator's expertise on the subject matter and using this insight to arrive at a mutual agreement. Thus, arbitration is most commonly used for resolving construction disputes in the US.

Design/build alternative: a contracting method

Article Abstract:

Design/build implies that a single business entity has been assigned to design a project and build it. It is not necessary for the design/builder to have in-house design and construction capabilities. A contractor may subcontract the design work or an engineering firm may outsource the construction work. Statistics from Design-Build Institute of America and F.W. Dodge DATELINE Services show approximately 18% of the $212 construction market from Apr 1995 to Apr 1996 were design/build contracts.
