Obligations circular meets warm response for clarity

Article Abstract:

Guidance entitled 'Circular 1/97' issued recently by the UK government emphasises the principle that planning permission may not be bought or sold. The improved clarity of this document compared with the draft has been welcomed by planning professionals. The new document makes a number of changes from the draft concerning the clarification of the use of obligations, and also widens the scope of planning obligations. Some observers have expressed concern about the emphasis on obligations for transport improvements at out-of-town locations over town centres.

Transport audit on planning proposals should be norm

Article Abstract:

Land-use planning and transport planning are not linked closely enough in the UK, according to Jack Short, deputy secretary-general of the European Conference of Ministers of Transport. Greater efforts should be made to deal with traffic congestion by ensuring that planners undertake transport audits on applications. At present, transport projects are subject to an environmental appraisal, but there is no transport audit for planning proposals.

'Dynamite' appeals draft launched by DoE

Article Abstract:

The UK DoE aims to reduce delays in the planning appeals procedure and to ensure that the procedure is more user-friendly. It has recently published a draft circular which suggests measures including giving the planning inspector an enhanced role, encouraging informal hearings, rather than full inquiries, and using pre-inquiry discussions. Such measures will make it unnecessary for local authorities to employ lawyers for small-scale appeals.
