Off to a flying start: problems caused by half finished planning permissions are the bane of many in local authorities

Article Abstract:

Legislation to solve the problem of partly implemented planning permission did not win government support. The proposed legislation would have placed further burdens on local planning departments. A section of the Town and Country Planning Act 1990 subjects planning permission to the condition that it be started within five years from the date of permission, otherwise permission will lapse. However there are no constraints on the time in which a development must be completed, and partly implemented planning permission can be dealt with by the serving of a completion notice.

Counting the costs

Article Abstract:

The Department of the Environment is likely to impose costs on local authorities if they fail to follow strict guidelines on planning applications. The authority must, for example, ensure that all appellants of refused planning applications are given a specific reason for the refusal. The appellant is also liable to costs if any part of the development plan policy is ignored. Other restrictions and case examples are discussed.

Article Abstract:

Projected social housing requires 180,000 to be built from 1996 to 1999. The Department of the Environment has detailed in a circular the requirements. Included in the circular is Section 106 which seeks to structure planning commitments. Within the Housing Act 1996 several changes are made which will affect Section 106 and planners must be cognizant with these.
