Resolving construction disputes by mediation: Hong Kong experience

Article Abstract:

To settle disputes in the Hong Kong construction industry, a modern method of mediation is used. This method which has roots in Confucian philosophy, is considered a cost effective alternative to legal litigation. Although informal in nature, mediation remains an effective and fast way of solving conflicts. The success of mediation as a dispute settlement mechanism has proven to be highly successful in Hong Kong and should be used as a model by other countries as well.
